FRANKLIN COUNTY SHERIFF’S OFFICE PRESS RELEASE TYPE OF INCIDENT: DUI OFFICER: McHugh DATE OF INCIDENT: 02-19-06 TIME OF INCIDENT: 2045 LOCATION OF INCIDENT: St. Albans, VT NAME: NIEMAN, Mary AGE: 36 ADDRESS: St. Albans, VT SUMMARY OF INCIDENT: On February 19, 2006 at approximately 2052 hours, I responded to a motor vehicle accident at he McDonald’s Restaurant on Swanton Road in St. Albans Town. I was advised by dispatch that the complainant was a tractor trailer driver for McDonald’s and that a red Ford Explorer bearing a Vermont Registration had hit his truck and had left the accident scene. He stated to dispatch that the operator and her male passenger might both be intoxicated. I issued a be-on-the-lookout bulletin to stop and hold the red Ford Explorer. At approximately 2108 hours I located this vehicle traveling southbound on Route 7 in the area of the Energizer Battery Plant. I conducted a motor vehicle stop and identified the operator as Mary Nieman. I immediately smelled the odor of intoxicants emanating from the interior of her vehicle. I administered her field sobriety exercises and she was subsequently arrested and processed for driving under the influence. The complainant’s tractor trailer was not damaged, Neiman’s vehicle sustained minor damage as a result of the incident.
