FRANKLIN COUNTY SHERIFF’S OFFICE PRESS RELEASE TYPE OF INCIDENT: Possession and Control of Regulated Drugs – Selling on School Grounds OFFICER: McHugh DATE OF INCIDENT: 02/03/06 TIME OF INCIDENT: 0730 LOCATION OF INCIDENT: St. Albans NAME: LAVALLA, Kenneth AGE: 17 ADDRESS: Georgia, VT NAME: Unnamed Juvenile SUMMARY OF INCIDENT: On February 4, 2006 at approximately 9:30pm, I was dispatched to a report of a theft of prescription medications which had occurred on Fairfax Road in St. Albans Town. The complainant stated that a third party had informed her that he (the third party) had overheard students at the BFA St. Albans basketball game on 02-03-06 saying that if you wanted pills, talk to the complainant’s juvenile son. Upon hearing this, the complainant checked her prescription bottle and found some of her prescription pulls to be missing. The complainant then confronted her son with the facts of the missing pills and the rumor that he was selling them at school The complainant stated that her son confessed to her that he had taken the pills and brought them to school where he gave them to another student, Kenneth Lavalla with the intention that Lavalla would sell the pills and split the money with him. I spoke to the juvenile at the scene and he stated that on 02-02-06, during the afternoon, he took 15 Vicodin pulls from his mother’s prescription bottle. He stated that he did this because Kenny had told him that he could sell the pulls for him at school. He stated that on 02/03/06 he brought the 15 pills to school and gave all 15 pills to Lavalla at BFA St. Albans. Lavalla started to give the juvenile money throughout the day on Friday. The juvenile stated that Lavalla would give him money as he sold the pills throughout the day. The monetary transaction was conducted at school. Both the complainant and her son provided sworn statements. Lavalla was interviewed and denied any involvement in this case. He declined to give a sworn statement at the time of the interview. Lavalla was subsequently cited to appear in Franklin District Court at a later date.
